Mark your calendars for the EDA’s Construction and Infrastructure Forum happening on May 4, 2021 and presented in partnership with Osler. Osler is a leading business law firm practicing internationally from offices across Canada and in New York.

This half-day session will include a mix of legal, regulatory and sector perspectives, with leading experts speaking to unique constraints and considerations.

Topics to be covered include:

  • How to address COVID-19 in construction contracts – Understanding the contractual implications of COVID-19 in existing contracts and best practices for addressing COVID-19 in new contracts.
  • Responsibility for delays on construction projects – Consideration of delays caused by owners, contractors, third parties, and events beyond anyone’s control (force majeure). And when is cost and schedule relief appropriate, and when is just schedule relief appropriate.
  • Ontario’s new Construction Act – New requirements regarding prompt payment, mandatory adjudication, and other changes to its predecessor, the Construction Lien Act.

Major construction & OEB regulatory considerations – A review of recent Incremental Capital Module decisions for major construction and OEB’s treatment of COVID-19 delays.
